Isinatabi muna ng Senate Committee on Public Services na pinamumunuan ni Sen. Grace Poe ang pag-apruba ng franchise application ng NOW Cable and News and Entertainment Network Corporation (NEWSNET) – sister company ng NOW Telecom na may P2.6 bilyong pagkakautang sa gobyerno dahil sa unpaid supervision and regulation fees (SRF) and penalties.

“For now, and I don’t want anymore to delay this [public hearing], we will have to defer this one,” sabi ni Poe sa kinatawan ng kumpanya sa pagdinig ng Senado sa pag-rebyu ng aplikasyon ng mga prangkisa na isinumite ng iba’t ibang pribadong kumpanya.

Nang isalang na ang NOW Cable, inusisa ni Poe ang isyu ng ownership at tinanong kung ang mga dating tao pa rin ang nagpapatakbo ng NOW Telecom na inamin naman ni Atty. Henry Abes, pangulo ng parent company NOW Corporation na, “Yes, it’s the same owners”.

“You see, the same owners of NOW Broadcast or NOW Cable are also the owners of NOW Telco. I have to bring this up because the characters behind it is also crucial to whether or not they will be given a trust by Congress for a franchise,” paliwana gni Poe.

Dahil ang pagbibigay prangkisa ay isang pribiliheyo, sinabi ni Poe na kailangang pagkatiwalan ang mga karakter sa likod ng franchise application. Aniya, ang hindi pagbabayad ng P5,000 penalty sa Securities and Exchange Commission ay isang basehan mismo para hindi pagkalooban ng prangkisa ang kumpanya.

“So I think this is something that really needs scrutiny. If you have that much money owed to the government, why will the government trust you with another franchise and to the same owner?” sabi nito.

Ayon pa kay Poe, sinisingil ng National Telecommunications Commission (NTC) ang NOW Telecom ng mahigit P2.6 bilyong hindi nabayarang SRF at penalties na naipon na mula pa noong 2004.

Dagdag pa nito, ang telecoms regular, sa pamamagitan ng Office of the Solicitor General, ay naghain na ng mosyon sa Supreme Court na humiling na pabayaran sa kumpanya ang kanilang obligasyon sa gobyerno. Nakabinbin pa sa High Tribunal ang desisyon para dito.

Nang hingan ng komento hingil sa aplikasyon ng prangkisa ng NOW Cable, kinumpirma ni NTC Commissioner Gamaliel Cordoba sa komite na ang may-ari nito ay siya ring owner ng NOW Telecom.

“I think it’s same owners, the same group, and in the Supreme Court, your honors, actually they are the ones contesting the decision of the Court of Appeals which already affirmed the decision of the NTC regarding the amount that they have to pay,” sabi ni Cordoba.

Kinumpirma din nito kay Poe na sinusubukan ng gobyerno na kolektahin ang utang ng NOW Telecom na kinumpyut sa tulong ng Commission on Audit.

“There are a lot of confusing things in this particular franchise application. That they’re non-operation for a period of time, the change of ownership and then now the sister company having these liabilities,” ayon kay Poe.
