Pinawawalang-bisa ng 15 leader ng Bangsamoro Autonomous Region in Muslim
Mindanao (BARMM) sa Korte Suprema ang ilang probisyon sa Bangsamoro Electoral Code (BEC) na inisyu ng Bangsamoro Transition Authority (BTA) at pinirmahan ni BARMM Interim Chief Minister Ahod Balawag.

Sa petisyon na inihain ni election lawyer Romulo Macalintal, kasama sina Atty. Ace Bautista at Atty. Christopher Rodriguez, kanilang tinawagang-pansin ang Korte Suprema para bigyan ng temporary restraining order ang BTA para ilatag ang BEC.

Ang BEC ay napirmahan bilang batas noong March 8, 2023, at magiging epektibo noong May 17, 2023, 15 araw matapos ma-publish ang naturang batas sa lokal na diyaryo sa Mindanao.

Ayon sa mga petitioner, ang BEC ay nanghihimasok sa kapangyarihan gn Supreme Court na magtakda ng rules at regulations pagdating sa mga election case na nakahain sa lower court.

Isa pa rito ay sinasakop din ng BEC ang constitutional power at duty ng Commission on Elections (Comelec).

“(It) is well-settled that COMELEC has broad powers to enforce and administer all
laws and regulations relative to the conduct of elections and over all electoral contests
relative to the election of regional, provincial, and city officials” citing Sec. 2 of Article
IX-C of the Constitution

Pinuna rin ng mga BARMM leader ay ang probisyon sa BEC na posibleng gamitin para magastos public fund para sa kampanya at iba pang partisan political activity.
